General Terms Of Service

I reserve the right, at my sole discretion, to cease work with a customer unless the below terms are honored. Customers (those who commission me or otherwise request artwork in exchange for monetary compensation) will pay me FULL price of the commission upon my request. Paying equals consenting to my terms of service.
 

Licenses & Usage

I may refuse to post a commission to my social media as I see fit. If a customer does not want me to post their commission, they must specify during the process of their commission. I will honor their request, so long as they honor the below terms. I reserve the right to use commissions as examples or advertisement.

 

Commissions are for personal use only (i.e. use on social media with credit, home decor, digital backgrounds, etc.) unless otherwise specified and paid for. I do not allow my work to be resold, nor do I allow it to be reposted without explicit permission and credit. It is strictly prohibited to use my work in NFT or AI projects. Customers may not recolor, alter, or otherwise edit my artwork without permission.

For crediting me, I ask the customer to link to any of my active social media, be it by "tagging" or "@ mentioning" me or by creating a link to any of my socials. I go by @Mirbon.art on Instagram, and use the username Mirbon on Artfol, Artfight, Toyhou.se and Ko-Fi.

Process & Etiquette

I will generally consult with customers throughout the commission process, sending them updates on their commission at each stage of the drawing— Concept & Sketch, Lineart, Color, and Shading. Once I move from one stage to the next, the content of the previous stage cannot be changed without warning and compensation. Major changes to the overall composition, concept, or character that would require the piece to be reworked in full will not be accepted at the original price.

 

Customers do have the option to forego check-ins in exchange for faster turnarounds. The usual turnaround time for a work to be completed varies, commissions may take up to 4 weeks to be completed in full.

For character art I ask the customer to have a clear reference sheet available. This should at least include a flat colored full body work, or clear photos if I happen to be working on a pet portrait or similar. I have the right to refuse a commission if reference photos are of a quality I feel like cannot work with, up to my discretion. 

 

While working with me, customers are expected to remain courteous. Should a customer blatantly insult myself, my work, or other customers, I will, at my sole discretion, cease work with them and no further recourse is available. This does not mean I am not open to constructive criticism or suggestions on the direction of a piece, I will not tolerate disrespect towards myself or my customers. 

I am open to working with deadlines, for example when working on birthday gifts. The customer must inform me of these when ordering a commission. If the deadline is on a very short notice I reserve the right to charge a rush fee, which consists of me charging +25% extra on top of the base price for a commission. Any rush fees will be discussed beforehand when determining the commission quote.

I reserve the right to accept or deny commissions from customers, at my sole discretion, based on the content of their requests.

Payment & Refunds

All payments will be made upfront or after completion of the sketch, in full. Should a customer not pay, and refuse or ignore subsequent requests for payment, the commission will not be accepted, completed, or delivered, and no further recourse is available. 

If a customer wishes to cancel their commission, they can expect to be refunded depending on when they cancel, up to 50% of the original price. For the sake of convenience, commission progress will be broken up per character and an eventual background. If no progress has been made on my part at the time of cancellation, 95% of the full price will be refunded.

  • When a commission is cancelled during or after the sketch phase, a 50% refund will be given.

  • When cancelled during the line art phase, a 25% refund will be given.

  • If cancellation occurs during the flat color stage, no more refund will be given.

 

If a customer does not pay, or breaks my TOS in such a way that I will have to stop working with them, the right of the customer to use any imagery I have produced for them thus far is forfeited. If a customer asks to cancel their commission they may however use what I have produced up until that point, as described under the licenses and usages section.

Any of my prices are non-negotiable.
